GMB, the union for NHS workers, warned that Andrew Lansley's confidence in Foundation Trusts' ability to control the increase in income from private patient treatment is not shared by regulator 'Monitor'. The raising of the private patient income cap from around 2% up to as much as 49% is one element of the Health and Social Care Act.
GMB publishes today NHS Foundation Trust regulator Monitor's official risk ratings which show that 20 Foundation Trusts are on “red” alert with regard to their Governance of Trust affairs. A further 48 Foundation Trusts are on “amber-green” or “amber-red”, signalling “limited” or “material” concern. See Notes to Editors for full list of all 144 NHS Foundation Trust 'Governance' flags.
The Governance risk ratings are: Red means 'Likely or actual significant breach of terms of authorisation', Amber-red means 'Material concerns surrounding terms of authorisation', Amber-green means 'Limited concerns surrounding terms of authorisation' and Green means 'No material concerns'.

Rehana Azam, GMB National Officer for the NHS said,“GMB believes that there is a real danger that Foundation Trust hospital governors will succumb to the temptation to make a quick buck from treating a much larger number of private patients.
GMB is calling on the government to leave the private patient cap where it is at around 2% of total income and provide our hospitals with the fair funding settlement they were promised.
GMB has been one of many voices warning that the government's confidence that Foundation Trust hospitals can generate up to 49% of their income from private-sector activity without pushing many NHS patients to the back of the queue is misplaced.
The coalition claims that governance arrangements will be strong enough by October to ensure that hospital managers do the right thing by their NHS patients, but the ratings we've published today cast real doubts about this. The judgment of the Regulator 'Monitor' is that many Foundation Trusts don't appear to be well-governed.”
